:: Information about our Terms Of Service :: General
By ordering services from DILIGENThost you agree to our Terms of Service Agreement. We reserve the right to modify this Terms of Service Agreement from time to time without any prior notification (we will notify existing customers). The modified agreement will apply to existing and future customers.
Payment of Fees
You are expected to pay DILIGENThost in the amount agreed upon for the services provided to you. The amount will not change for the life of your account with us, except in cases of promotional sales unless otherwise stated in the promotion. These fees are subject to change at any time, but we will provide a 30 day notice before these fee changes take place.
Currently, we are set up to accept payment through all major credit cards and PayPal. If you fail to make payments as agreed, we will stop performing the agreed upon service.
Our Services
When we make our agreement to work together, you may select a hosting package containing the services you desire. From time to time, we might need to make changes to these services. In most cases, these services are made in order to offer better services to you. We have the right to make these changes, but we promise that any changes will still result in providing you with equal or better services to what you are already receiving.
Network policy
We do not allow any under age pornographic material, warez, piracy and cracks related content, proxies. Use of our services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as pyramid schemes, ponzi schemes, hyip schemes, and chain letters, are prohibited on our servers.
Backup policy
All our servers are backed up twice a day, even though they are already on secure fault-tolerant RAID systems. These backups are not accessible through regular everyday requests, as they are entire server backups, and are meant specifically to restore an entire server. Individual account backups can be initiated by the customer using the control panel.
Guarantee's
30 day money back guarantee - If you are dissatisfied with our services and wish to end your subscription, let us know within 30 days following your accounts activation. Without any additional requirements or explanations, DILIGENThost will completely reimburse you for the monthly fees paid, elapsed or prepaid.
Network & Power uptime guarantee - If we do not meet our uptime policy, we will give a one month credit to the affected accounts for every 15 minutes of downtime. This guarantee is in no case applicable, without being limited, to unavailability caused by hardware or software malfunctions, to planned maintenance activities or to any event that is not directly under DILIGENThosts direct control.
Reoccurring payments
Once you decide on a service package from DILIGENThost, that package will specify how long our agreement will be in place. This time period starts as soon as your account is activated. We will automatically renew your agreement and will charge you in the same way we agreed when you first signed up for our service. If you decide you no longer want our services – and we hope that doesn’t happen – just notify us and your account will not be renewed when your current contract ends.
Suspending or Terminating Accounts
We hope that this never happens, but you should know that we have the right to suspend or to even terminate your account if you fail to live up to our agreement.
CGI & PHP Scripts / system resources
Each account comes with its own cgi-bin. You are free to use any CGI & PHP scripts you wish, however we reserve the right to disable any CGI or PHP script that effects normal server operation without prior warning. Any Client website that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given an option of either paying extra (which depends on the resource needed) or reducing the resource used to an acceptable level. DILIGENThost shall be the sole arbiter of what is considered to be a high server usage level.
SSH Access
SSH is not given out without request/reason, and the usage is very closely monitored (we log & review every command & IP). Any attempt to SSH into our servers via proxy will result in immediate removal of shell privileges. We may or may not ask for a form of ID, however please be prepared should it be requested. When we do provide a shell, it is a jailed shell, however allows you to work with your account without any problems. These shells are provided on a 24 hour temporary basis, we may or may not allow exceptions.
Account transfers
We will gladly help with having your accounts/databases/email/etc transferred to our servers. Once your account with us is active, you can submit a support request and we can initiate the transfer. If your previous host is using cPanel/WHM, you can provide us with your login details to your previous host and this will speed up the process. Otherwise, please include any information about how you access/manage your sites with your previous host in the support request.
